Data Privacy and Protection

Our data protection practices are in line with the provisions of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz(BDSG)). The following information is intended to give you an overview of how we process your personal data and your rights under data protection law.

2. Server log files

(a) The provider of this website and its pages automatically collects and stores information in so-called server log files, from the device used to access it (e.g. computer, mobile phone, tablet, etc.). The information comprises:

(1) the type and version of browser used;
(2) the used operating system;
(3) hostname of the accessing computer;
(4) the IP address;
(5) Date and time of the server inquiry;
(6) Websites and resources (images, files, other page content) accessed on our website;
(7) Websites from which the user’s system accessed our website;
(8) Message indicating whether the retrieval was successful;
(9) amount of data transferred.

(b) This data is not merged with other data sources. This data is recorded based on Art. 6 Sect. 1 lit. f GDPR. The operator of the website has a legitimate interest in the technically error free depiction and the optimization of the operator’s website. To achieve this, server log files must be recorded.

3. Contact us

When you contact us (e.g. via contact form, email or telephone), the information provided by the person making the inquiry will be processed to the extent necessary to answer the contact requests and any requested measures.

Contact enquiries that are made in the context of contractual or pre-contractual relationships and to which the data subject is a contracting party are to be treated in accordance with Art. 6 Para. 1 S. 1 lit. b. GDPR is just as lawful as contacting us based on a legitimate interest pursuant to Art. 6 Para. 1 S. 1 lit. f. GDPR or your implied consent pursuant to Art. 6 Para. 1 S. 1 lit. a. GDPR.

We process the following types of data: inventory data (e.g. names, addresses), contact data (e.g. e-mail, telephone numbers) and content data (e.g. entries in online forms).
Data Subjects are our communication partners.
The data processing serves the purpose of contact requests and communication.
The data will only be stored for as long as it is necessary to fulfill the reason for the contact.

4. Server location

Personal data is primarily stored and processed in the EU or EEA.

5. Transfer of your data to third parties

Your data will not be passed on to third parties.
We use external data recipients to fulfill the contract or with your consent or to protect the legitimate interests of the person responsible or a third party. The recipients of this data may include, for example, payment institutions as part of payment transactions, service providers commissioned with IT tasks or providers of services and content that are integrated into a website. In such cases, we observe the legal requirements and conclude appropriate contracts or agreements with the recipients of your data that serve to protect your personal data.

6. Right do erasure

Personal data will be erased immediately if one of the following grounds applies and there are no overriding legitimate grounds for the processing:

  • the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • the data subject withdraws consent on which the processing is based according to point (a) of Article 6(1) GDPR, or point (a) of Article 9(2) GDPR, and where there is no other legal ground for the processing;
  • the data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR;
  • the personal data have been unlawfully processed.
 

7. Right to object

The data subject shall have the right to object, on grounds relating to his or her situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions. We will comply with your request if there are no legally permissible reasons for further processing.

8. Further rights of the data subject

8.1. Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in the Member State of their habitual residence, place of work or place of the alleged infringement. The right to lodge a complaint is independent of any other administrative or judicial remedy available.

8.2. Right to data portability

You have the right to request that we provide you or a third party with the data that we process automatically based on your consent or in fulfilment of a contract in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if it is technically feasible.
The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

8.3. Information about, blockage, rectification and eradication of data

The data subject has the right to obtain confirmation from the controller as to whether personal data concerning him or her are being processed; if this is the case, he or she has the right to information about this personal data. If the legal requirements are met, you have the right to have this data rectified, blocked or erased.

8.4. Right to withdraw his or her consent

The data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Prior to giving consent, the data subject shall be informed thereof.

These pages are also the property of TÜV | DEKRA arge tp 21 GmbH. The Privacy Policy set out in this document therefore applies.
The legal basis for the collection of data in the context of testing our products is Art. 6 Para. 1 Clause 1 Letter a (your consent) and b (the processing is necessary for the performance of a contract or for the implementation of pre-contractual measure) GDPR.

10. Information for job applicants

Thank you for your interest in a position in our company. The protection of your personal data during the application process is an important concern for us.

In the following, we would like to explain which data we collect in this context and what happens to this data.

(a) Purpose of data processing

We process the data that you send us in connection with your application to check your suitability for the advertised position and to be able to carry out the application process.
The application is processed digitally by our application tool. Digital processing allows us to better track the status of your application and assign it to the appropriate contact person.

(b) Legal basis for data processing
Processing is carried out in accordance with Art. 88 para. 1 GDPR in conjunction with Section 26 BDSG and Art. 6 para. 1 letter a and b GDPR.
If you provide us with personal data of a special category, such as health information, the processing is based on your consent in accordance with Art. 9 para. 2 letter a GDPR.

(c) Recipients of the data
Only we have access to the applicant data.

(d) Duration of storage
If no employment relationship is established, your data will generally be deleted after 6 months at the latest, unless there is a legitimate interest in the further storage of the data in exceptional cases.
If you have given us your consent to include your data in our applicant pool, we will store your data for one year.

(e) Right of objection and deletion
You can object to the processing at any time in accordance with Art. 21 GDPR and request the deletion of data in accordance with Art. 17 GDPR. To find out what rights you have and how you can assert them, please refer to point 8 of this data protection notice.

(f) Necessity of providing personal data
The information in the application form is neither contractually nor legally required but is necessary for sending and processing the application. If you do not fill in the mandatory fields or do not fill them in completely, your application cannot be sent or processed.

(g) Use of QR codes
The QR codes we place on the job vacancy pages only contain the URL of the respective page and do not feature any tracking. This means that the data of users who scan the QR code is not or cannot be recorded by us.

11. Links to other websites

This website may contain links to third-party websites. We are not responsible for the data protection measures or the content of websites outside our company. For this reason, we recommend that you carefully read the privacy statements of these third-party websites.

12. Cookies and social plugins

We completely dispense with the use of non-essential cookies and social plugins.

13. Nutzung von Kartendiensten

We use a map section from OpenStreetMaphttps://www.openstreetmap.de), um für Sie den Anfahrtsweg zu unserem Unternehmen darzustellen und Ihnen die Planung der Anfahrt zu vereinfachen. Bei OpenStreetMap handelt es sich um ein sog. Open-Source-Mapping-Werkzeug, das von der OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom angeboten wird.  Durch die Verwendung dieser Kartenfunktion werden Nutzerdaten an den OpenStreetMap übermittelt und dort gespeichert. OpenStreetMap sammelt Informationen über Ihre Interaktionen mit der digitalen Karte, Ihre IP-Adresse, Daten zu Ihrem Browser, Gerätetyp, Betriebssystem und an welchem Tag und zu welcher Uhrzeit Sie den Dienst in Anspruch genommen haben. Dafür wird auch Tracking-Software zur Aufzeichnung von Userinteraktionen verwendet.
